MODEL RELEASE - Default

 

This is an agreement between Jeff Bennion and his assigns (“Photographer”) on the one hand and the model, as identified below, on the other hand. As used herein, “assigns” includes any workshop or event attendees and any legal entities created by Jeff Bennion related to professional photography. The Model hereby grants to Photographer the following rights:

1. Photographer will have the irrevocable and perpetual right, but not the obligation, to use, as they may desire, all video and/or photographs where I may be included for editorial trade, product advertising and such other fashion/business purpose in any matter and medium. This includes the right to use the model’s name, and likeness in connection with the advertising, publicizing, and exhibiting, in whole or in part, in any manner whatsoever, by any and all means, media, devices, and processes now or hereafter known or devised in perpetuity. The content may be combined with other images, text, or graphics. Images may be modified.

2. Photographer has the right to incorporate any advertising or promotions related thereto, any photographs, and/or video in which I appear, and I hereby waive any right to any additional compensation therefore, including but not limited to any excerpt and/or reuse fees and/or residual payments.

3. I hereby release the Photographer from any and all claims and demands arising out of or in connection with the uses set forth herein, including, without limitation,any and all liability arising out of published photographs and/or video.

4. I acknowledge that I am eighteen (18) years of age or older or, if the individual participating in the images, photographs, video /giving the appearance is under the age of eighteen (18) years, I am the parent or legal guardian of such individual and am signing below on their behalf and that such minor individual will be bound by all releases, consents and covenants contained in this model release.I further acknowledge that I have read this release in its entirety. I fully understand it, and I have resolved to my satisfaction all questions concerning its content.

MUTUAL RELEASE FOR TRADE FOR PRINT SHOOTS - MUTUAL COMMERCIAL USE AUTHORIZED

 

This is an agreement between _________  (“Photographer”) on the one hand and the model __________ on the other hand. Whereas, the Model has agreed to forego any financial compensation from the Photographer and the Photographer has agreed to forego any financial compensation from the Model, and the parties understand that the time and talent of the other party represents valuable consideration exchanged. The parties hereby enter into the following agreement:

1. Photographer shall retain the copyright of all images created during the collaboration between the Model and the Photographer, including the right to duplicate, publish, modify, and combine with other images.

2. The Model authorizes the Photographer to use any image created during the collaboration for any commercial purpose, including but not limited to advertising, the sale of any image, and the publication of any image. This includes the right to use the model's name and likeness.

3. The Photographer grants the right to the Model to use any image created during the collaboration for any commercial purpose, including but not limited to advertising, the sale of any image, and the publication of any image.

4. The parties understand and agree that the right to use an image does not create an obligation on either party's behalf to use any image created during the collaboration.

5. The parties understand and agree that wherever possible, they must provide full credit for the picture, including the name of the Model, the Photographer, makeup artist, hairstylist, creative director, stylist, designer, or any other person who assisted in the creation of the image.

6. The photographer understands that he/she must provide a reasonable number of pictures of professional quality to the Model within a reasonable timeframe.

7. The parties hereby waive any right to collect from each other any royalties, fees, or payment of any kind relating to the use of any image created during the collaboration.

MUTUAL RELEASE FOR TRADE FOR PRINT SHOOTS - COMMERCIAL USE NOT AUTHORIZED

 

This is an agreement between _________  (“Photographer”) on the one hand and the model __________ on the other hand. Whereas, the Model has agreed to forego any financial compensation from the Photographer and the Photographer has agreed to forego any financial compensation from the Model, and the parties understand that the time and talent of the other party represents valuable consideration exchanged. The parties hereby enter into the following agreement:

1. Photographer shall retain the copyright of all images created during the collaboration between the Model and the Photographer, including the right to duplicate, publish, modify, and combine with other images.

2. The parties understand that neither the Model nor the Photographer may use any image for any commercial purpose. Commercial purpose shall include, but is not limited to sale, advertising, or any use for which the party receives financial compensation, including the use on any paid subscription site. Commercial purpose does not include using the images in a portfolio or as part of an advertisement for that Party's professional services.

3. The Photographer grants the right to the Model to use any image created during the collaboration for non-commercial purposes.

4. The use of any image created during the collaboration for commercial purposes must be covered under a separate agreement.

5. The parties understand and agree that the right to use an image does not create an obligation on either party's behalf to use any image created during the collaboration.

6. The parties understand and agree that wherever possible, they must provide full credit for the picture, including the name of the Model, the Photographer, makeup artist, hairstylist, creative director, stylist, designer, or any other person who assisted in the creation of the image.
